The article discusses the approach of tax authorities and administrative courts towards taxation of value added tax on the sale of non-agricultural land, inherited or acquired by way of donation. The article also includes an assessment of this approach, made through the prism of the judgment of the Court of Justice of the European Union in joined cases C-180/10 (Słaby) and C-181/10 (Kuć ).
