Abstract

This article aims to compare the main principles of criminal procedure during the time of the Hammurabi Code with the general principles of contemporary Polish criminal procedure. This is done by comparing selected features of the criminal procedure during the time of the Hammurabi Code with selected principles of modern criminal procedure in Poland, while explaining the difference between features and principles of the process. The main research instrument is an in-depth exploration of the doctrine regarding the principles of criminal procedure currently, as well as studies on criminal procedure during the time of Hammurabi. This allows for a broader perspective on the contemporary process and drawing patterns from a famous and groundbreaking legal regulation, whose remnants can still be observed today.
